Terms and conditions
Effective Date: 22nd April 2024
This contract contains the entire agreement between the Client and the SAVIA ROCKS PHOTOGRAPHY and supersedes any prior agreements or understandings, whether written or oral. Any changes to this contract must be in writing and signed by both parties. If any provision of this contract is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This contract shall be governed by the laws of the jurisdiction in which the portrait session takes place.
LIABILITY
The Photographer will take reasonable steps to ensure that all equipment is safe and secure during the photography session. However, the Photographer is not liable for any injuries, damages, or other losses that may occur as a result of the photography session. The Client agrees to release and hold harmless the Photographer and their employees from any claims, damages, or liability arising from the portrait session. The Client is responsible for any damage caused to the Photographer's equipment or property during the session. The Photographer is not responsible for any loss or damage to digital files after they have been delivered to the Client. The Photographer is not responsible for any third-party claims against the Client or Photographer arising from the Client's use of the photographs. The Client is responsible for obtaining any necessary permits or permissions for the portrait session.
RESCHEDULING AND CANCELLATION
If the Client needs to reschedule the session, they must do so at least [specify timeframe, such as 48 hours] prior to the scheduled session time. If the Client cancels the session, the deposit will not be refunded. If Savia Rocks needs to reschedule the session due to illness or emergency, the Photographer will make every effort to reschedule the session at a mutually agreeable time.
PAYMENT
The Client agrees to pay the Photographer the total fee outlined in this Agreement for the photography services provided. A non-refundable retainer of 30% of the over all price is required to secure the Savia Rocks services for the date(s) specified in the Agreement, with the full balance due 72 hours prior to the event. Savia Rocks reserves the right to withhold delivery of the final product until all payments have been received. Any additional costs incurred by the Photographer, such as travel or accommodation expenses, will be billed to the Client and must be paid in full before the final product is delivered. In the event that the Client fails to make payment in full by the due date, the Photographer reserves the right to add charges of £35 per day for late payment, if payment is till not paid in full the Photography reserves the right to cancel this Agreement and the non-refundable retainer will be forfeited.
COMPLETION SCHEDULE
Savia will make reasonable efforts to deliver the completed photographs to the Client within a reasonable time after the session, typically within 5 to 14 days. The Client understands that the Photographer may need additional time to edit and retouch the photographs to ensure the highest quality and that the Photographer will not compromise quality for speed. If the Savia is unable to deliver the completed photographs within the agreed-upon timeframe due to unforeseen circumstances, Savia will notify the Client as soon as possible and provide a revised delivery date. The Client acknowledges that the delivery date is an estimate only and that the Photographer will not be held liable for any delays beyond their control.
USAGE RIGHTS
Savia retains the rights to all images produced as part of her photography services offering. Unless otherwise stated in writing the images produced will be granted the Client with an “All Purpose, All Media” usage license which means they are free to use the images in any way desired for as long as desired and places no restrictions upon their personal usage. The Savia reserves the right to use the photographs for promotional purposes, including on their website and social media, exhibitions and to submit the photographs for publication in photography competitions or publications etc.
CREATIVE CONTROL
The Client agrees to give Savia Rocks the creative freedom when it comes to editing and retouching images, with any specific requirements made in writing by the Client prior to the agreed wedding date. By signing this contract, the client is aware of the style of photography that SAVIA ROCKS produces.
INJURY / LOSS
The Photographer is not liable for any injury, loss, or damage to any person or property during the photography session. The Client assumes all responsibility for themselves, their guests, and their property, and releases the Photographer from any liability for injury, loss, or damage that may occur during the photography session.
RAW IMAGES
Savia Rocks will retain all rights to the RAW images captured during the photography session and will not provide them to the Client. Savia Rocks will provide a selection of edited digital images in high resolution format to the Client. The Client understands that RAW images are unprocessed and require significant editing before being ready for use, and Savia Rocks is not responsible for providing any raw images to the Client.
REFUND POLICY
Savia Rocks' commitment is to delivering quality and satisfactory service and/or products. In case the Client is not completely satisfied with our products we would do our best to resolve the issues to the best of our abilities. Please contact Savia Rocks via email or phone call explaining the specific areas of concern.
There will not be any refund for the Services already rendered in accordance with the service contract issued to you at the time of booking. Booking advances are non-refundable under any circumstances.
If the Client chooses to not take any deliverables agreed upon at the time of booking after the shoot is over, there will not be any refunds in any form (for instance, printed albums, videos, teasers etc.)
Any changes in the deliverables have to be informed to us in writing at least 30 days in advance from the first date of the shoot.
